Draft law to apply Credit Code to small business

Credit Reform Phase 2 bills* also include anti avoidance measures. Submissions due 15 February

The Hon Bill Shorten MP, has released for public consultation draft legislation to give effect to Part 2 of Phase 2 of the National Credit Reforms.

The exposure draft Bill introduces reforms in relation to:

  • Credit provided to small business;
  • Credit provided for investment purposes;
  • Some forms of private lending;
  • Short-term and indefinite term consumer leases;
  • The regulation of practices which seek to avoid the operation of the national credit law.

The Commonwealth Treasury has invited interested parties to comment on the exposure draft. See the Credit Reform Phase 2 page on the Treasury web site for information about how to make a submission

Closing date for submissions: Friday, 15 February 2013

  1. @jack seems to be no problem lending to consumers with Credit Code applying. I’m sure small business owners will benefit from increased information and better remedies when things go wrong.
